The recently enacted America Invents Act (AIA) represents the most significant change to the U.S. Patent Law System in sixty years.  The AIA effects all aspects of the U.S. patent system from obtaining patents, enforcing patents in litigation, and attacking invalid or overly broad competitor patents.  This presentation will look at the AIA and how successful companies in the chemical, energy, process and product development industries can utilize effective intellectual property strategies under the AIA to protect their technology and thwart competitors.  Particularly, this presentation will examine how companies can use new procedures under the AIA to quickly build a patent portfolio, strengthen issued patents, and enforce issued patents in litigation. Additionally, this presentation will address strategies for navigating the existing competitor patent landscape by using the new post-grant procedures created by the AIA.
